Liability Waiver

​DANCE AND FITNESS ONLINE CLASSES

1. I am participating in the Online Dance Lessons, offered by Zaiah Arts Ltd during which I will receive information and instruction about dancing.  I recognize that dancing requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

2. I agree to participate in physical fitness programmes run by Zaiah Arts Ltd which may include, but not necessarily be limited to dance fitness, Hiit, functional fitness training and weightlifting. Zaiah Arts Ltd has made me fully aware of the fitness programmes which they offer, and in which I agree to participate. I understand that physical exercise can be of a strenuous nature and may push me to the limits of my physical abilities.  I recognise and understand that the programme is not without varying degrees of risk which may include, but are not limited to the following: Injury to the musculoskeletal and/or cardiorespiratory system, which can result in serious injury or death. Injury or death due to negligence on the part of myself, my training partner, or other people around me. Injury or death due to improper use or failure of equipment. Injury or death due to a medical condition whether known or unknown to me

3. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Online Dance Lessons and fitness programmes. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in either of these.

4. In consideration of being permitted to participate in the Online Dance Lessons and Fitness programmes, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which might incur as a result of participating in the program.

5. In further consideration of being permitted to participate in the Online Dance Lessons and Fitness Program, I knowingly, voluntarily and expressly waive any claim I may have against Zaiah Arts Ld and/or its agents for injury or damages that I may sustain as a result of participating in the program.

6. I understand that recording of any of our online sessions offered in any form is strictly prohibited. I agree to not reproduce, sell, share or distribute any recordings of the Online Dance Lessons.

7. I understand that music used in the videos is not the property of Zaiah Arts Ltd and is for educational purposes only. By signing up for Zaiah Arts Ltd online classes does not grant me a license or permission to use third party copyright materials including music.

8. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Zaiah Arts Ltd and/or its agents for any injury caused by their negligence or other acts.

WELLBEING SESSIONS

1. I understand that the Wellbeing session I will be receiving from Zaiah Arts are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. I also understand that the coaches are not acting as a mental health counsellor or a medical professional. I understand that coaches will be offering suggestions to improve mental, nutritional, physical, relational, emotional, spiritual, financial and sexual wellbeing, 

2.  I understand and agree that I am fully responsible for my well-being during wellbeing sessions, and subsequently, including my choices and decisions. I understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and I will not use it in place of any form of therapy

3. I hereby release, waive, acquit and forever discharge Zaiah Arts Ltd, any coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself, Zaiah Arts Ltd or by any Coachs as a result of the advice given by my Coach or otherwise resulting from the coaching relationship contemplated by this agreement. I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents
